Representing a non-profit organization in a copyright dispute

Stuchlíková & Partners represented the nonprofit news portal for artists Artalk z.s. without charging a fee, in a copyright dispute concerning whether the use of a photograph under a Creative Commons license was lawful and whether damages were payable.

Creative Commons is a non-profit organization whose goal is to provide authors with various licensing schemes so that the public can use their works in a specific manner without obtaining the author’s consent. The most permissive Creative Commons license, for example, allows the public to copy, distribute, or exhibit a work subject only to identifying the author. The most important projects whose content may be licensed under one of the Creative Commons licenses include Wikipedia encyclopaedia or the community web for sharing Flickr photos.
